By accessing or using our website, you agree to these Terms, our Privacy Policy, and our Refund & Return Policy. If you do not agree with these Terms, please do not use our website or place an order.

1. ABOUT PAINTINGS AND BL

Paintings and BL is an independent art business offering original, hand-painted artworks created by a self-taught artist.

Unless otherwise stated, artworks displayed on our website are original pieces and are sold directly by Paintings and BL.

Our online store is hosted and powered by Shopify, which provides the e-commerce platform that enables us to sell our products and services online.

2. ELIGIBILITY AND WEBSITE USE

By using our website or placing an order, you confirm that:

  • You are legally capable of entering into a binding transaction under applicable law.
  • The information you provide is accurate, complete and current.
  • You will use our website only for lawful purposes.
  • You will not use our website to engage in fraudulent, abusive or unlawful activity.

We reserve the right to refuse service, cancel orders or restrict access to our website where we reasonably believe that these Terms have been violated or that fraudulent or unauthorized activity has occurred.

3. OUR ARTWORKS

Each original artwork is individually hand-painted and may contain natural variations in brushwork, texture, colour, finish and other characteristics.

Because artworks are photographed and viewed on different screens and devices, colours may appear slightly different from the physical artwork.

Dimensions, materials, descriptions and other artwork information are provided as accurately as reasonably possible.

We reserve the right to update product descriptions, photographs, availability and pricing when necessary.

Original Artwork

Unless expressly identified otherwise, an artwork described as an Original Artwork is a one-of-a-kind, hand-painted piece and is not a print or reproduction.

Purchasing an artwork does not transfer copyright or intellectual-property rights in the artwork to the buyer. Copyright and reproduction rights remain with the artist unless expressly agreed otherwise in writing.

4. PRODUCT AVAILABILITY

Our original artworks are unique and may only be available in a single quantity.

Because of their one-of-a-kind nature, an artwork may become unavailable without notice if it has already been sold or reserved.

We reserve the right to discontinue or remove any artwork from our website at any time.

5. ORDERS

Placing an order constitutes a request to purchase the selected artwork.

An order is considered accepted once Paintings and BL has received the payment and issued an order confirmation, subject to any necessary verification.

We reserve the right to decline or cancel an order where:

  • Payment cannot be successfully processed.
  • The artwork is no longer available.
  • The transaction appears fraudulent or unauthorized.
  • Incorrect pricing or product information was displayed due to a technical or human error.
  • We reasonably believe the transaction may violate applicable law or these Terms.

If we cancel an order after payment has been received, any eligible refund will normally be issued to the original payment method.

6. PRICES AND PAYMENTS

All prices displayed on the website are stated in Indian Rupees (INR) unless otherwise indicated.

Prices may change without prior notice. The price applicable to your order will generally be the price displayed at the time the order is placed.

Depending on the destination and applicable laws, additional charges such as shipping fees, customs duties, import taxes or other government charges may apply.

Customers are responsible for reviewing the final order total before completing payment.

We accept payment methods made available through our website's checkout.

You confirm that you are authorized to use the payment method provided for your purchase.

7. SHIPPING AND DELIVERY

We carefully package each artwork before dispatch using appropriate protective materials and reinforced packaging.

Estimated delivery times are provided on our website and are estimates rather than guaranteed delivery dates.

Delivery may be affected by:

  • Incorrect or incomplete delivery information
  • Public holidays
  • Weather or other events outside our reasonable control
  • Import procedures in the destination country

Customers are responsible for providing accurate shipping information.

For international orders, the customer may be responsible for applicable customs duties, import taxes, clearance charges or other destination-country fees.

8. CANCELLATIONS, RETURNS AND REFUNDS

Orders may be cancelled, returned or refunded only in accordance with our Refund & Return Policy.

Because our artworks are original, one-of-a-kind pieces, returns due simply to a change of mind may not be accepted.

Customers should carefully review the artwork description, photographs, dimensions and other details before purchasing.

For damaged, incorrect or significantly misrepresented artwork, please follow the procedures described in our Refund & Return Policy.

9. INTERNATIONAL ORDERS

Customers purchasing from outside India are responsible for ensuring that the purchase and importation of the artwork complies with applicable laws and regulations in their country.

Any customs duties, import taxes, brokerage fees or other charges imposed by the destination country may be payable by the customer unless expressly stated otherwise at checkout.

Paintings and BL is not responsible for delays resulting from customs clearance or destination-country requirements.

10. INTELLECTUAL PROPERTY

All content appearing on paintingsandbl.com, including but not limited to:

  • Artwork photographs
  • Artwork images
  • Product descriptions
  • Text
  • Logos
  • Branding
  • Graphics
  • Website design
  • Original written content

is owned by or licensed to Paintings and BL and is protected by applicable intellectual-property laws.

You may view and use the website for your personal, non-commercial purposes.

You may not reproduce, copy, modify, distribute, sell, publish, commercially exploit or create derivative works from our artwork images, photographs, written content or branding without prior written permission.

Artwork Copyright

Purchasing an original painting does not give the purchaser the right to reproduce, photograph for commercial reproduction, resell as a reproduction, license, print or otherwise commercially exploit the artwork.

The physical artwork belongs to the purchaser after a completed sale, while copyright and reproduction rights remain with the artist unless otherwise agreed in writing.

11. PERSONAL USE

Unless otherwise agreed in writing, artworks purchased through Paintings and BL are sold for personal use, collection and display.

Customers may not represent themselves as the creator of an artwork purchased from Paintings and BL.

12. WEBSITE CONTENT AND ACCURACY

We make reasonable efforts to ensure that information on our website is accurate and up to date.

However, occasional typographical errors, pricing errors, technical errors or inaccuracies may occur.

We reserve the right to correct errors, update information, modify product details or cancel an order affected by an obvious error.

If an order is cancelled because of an error, any payment received for that order will be refunded where applicable.

13. THIRD-PARTY SERVICES AND LINKS

Our website may use third-party services, payment providers, shipping providers, applications or links to external websites.

We are not responsible for the content, availability, security or practices of third-party websites or services that are outside our control.

14. SHOPIFY

Our online store is hosted on Shopify.

Shopify provides the e-commerce platform that allows us to offer our artworks and services online. However, purchases made through our store are transactions between you and Paintings and BL.

Shopify is not the seller of our artworks and is not responsible for the products we sell, their condition, delivery, returns or refunds.

Your use of Shopify-powered features may also be subject to Shopify's applicable terms and policies. Shopify provides separate legal resources covering its services and merchant relationships.

15. PROHIBITED ACTIVITIES

You agree not to use our website to:

  • Engage in fraudulent or unlawful activity.
